Welcome to Doc to Doc Rentals! Doc to Doc Rentals, LLC (“Doc to Doc Rentals,” “we,” “us” or “our”) operates websites and mobile apps to enable eligible physicians to share information about their properties and offer them for rental, and to allow others to view, search, and book rental properties (collectively, our “Services”).
Anyone may visit our websites or download our apps to view and search properties. These Terms of Use (the “Terms”) govern all use of our websites, apps, and other Services by anyone. If you use our Services, then these Terms (including policies we link to from these Terms, such as our Acceptable Use Policy (at the end of these Terms) and our Privacy Policy [[LINK]]) are a legally binding contract between you and Doc to Doc Rentals. In these Terms all users of our Services are referred to as “you” or as a “User”. As a User you will not have access to the full content or functionality of our Services unless you become a Registered User.
Registered User Eligibility and Account Registration
To list, offer, or book a property for rental, you must be at least 18 years old and become a “Registered User” by creating an account and providing us with certain information about yourself. Your information will be used in accordance with our Privacy Policy. You are responsible for providing accurate, current, and complete information in connection with your account registration and for keeping such information accurate, current, and complete. Doc to Doc Rentals will determine the eligibility of each User to register an account and we reserve the right to accept or decline any registration in our sole discretion. Failure to comply with these Terms (including, as a reminder, our Acceptable Use Policy (at the end of these Terms) may result in suspension of cancellation of their account at our discretion.
You must keep your password and account information confidential, and you are solely responsible for all activities that occur under your password or on your account. You agree to immediately notify us of any unauthorized or compromised use of your password or account and to change your password if we instruct you to do so. We will not be liable for any losses caused by unauthorized use of your account. However, you could be held liable for losses to Doc to Doc Rentals or others due to such unauthorized use.
Guest means a Registered User when they are viewing, searching, or booking a Listing.
Listing means a Property that a Host has published through the Services. A Listing may or may not be available for rental.
Host means a Registered User when they are publishing a Listing or renting a Property in a Listing.
Property means a house, apartment, or condominium (or a defined portion thereof).
Reservation means a contract formed directly between the Guest and the Host at the time the Guest receives the booking confirmation for a Property.
Messaging and Contact. Registered Users can use the messaging functionality of our Services to contact each other within our websites and apps. Registered Users can make their contact information available. If you make your contact information available, you understand that other Registered Users may use that contact information to contact you directly. All messaging and other contact between Registered Users must be made in accordance with our Acceptable Use Policy (at the end of these Terms). In particular, you must not use messaging or contact information to defraud, defame, harass, stalk, threaten, or harm others, or otherwise violate laws or the legal rights of others.
Reviews. After each Reservation, Guests and Hosts may have an opportunity to review each other. If you review another Registered User or their Property, your review must be accurate and may not contain any discriminatory, offensive, defamatory, or other language that violates our Acceptable Use Policy (at the end of these Terms). Reviews are not verified by Doc to Doc Rentals for accuracy and may be incorrect or misleading.
Search. Any Registered User may use the services to search and book Listings. Users can either find Listings on a map, or search by location, number of guests, pet friendly, etc. When you use the search feature, results will be presented by relevance to your search and other criteria, and you may filter search results to help you narrow your search.
Booking. When you book a Listing, you are agreeing to pay all charges for your booking including the Listing price, deposits, applicable fees (such as cleaning or pet fees), taxes, and any other items identified during checkout (collectively, “Total Price”). In addition to these Terms, you will be subject to, and responsible for complying with, all terms of the Reservation, including the cancellation policy and any other rules, standards, policies, or requirements identified in the Listing or during checkout that apply to the Reservation. It is your responsibility to read and understand these rules, standards, policies, and requirements prior to completing any booking of a Listing.
Reservations. When you receive a booking confirmation through the Services, your Reservation is complete and you are entering into a contract directly with the Host. Doc to Doc Rentals is not a party to that contract. A Reservation is a limited license to enter, occupy, and use the Property. The Host retains the right to re-enter the Property during your stay, to the extent that it is reasonably necessary, permitted by your Registration, and legally allowed. If you stay past checkout, the Host has the right to make you leave in a lawful manner, including by imposing reasonable overstay penalties. You may not exceed the maximum number of allowed Guests.
Cancellations and Refunds. As a Guest, if you cancel a Reservation, the amount refunded to you is determined by the cancellation policy that applies to that Reservation, which will be identified in the Listing or during checkout that apply to the Reservation.
Modifications. Guests and Hosts are responsible for any booking modifications they agree to make via the Services, including any additional amounts, fees, or taxes associated with the modification.
Guest Responsibilities. As a Guest, you are responsible and liable for your own acts and omissions and are the acts and omissions of anyone you permit to enter or remain at the Property during your Reservation. This includes:
leaving the Property, any personal property on the premises of the Property, and the adjacent property in the condition it was in when you arrived;
paying all reasonable amounts for Damage Claims to cover damage to the Property caused by you, your pet, or anyone you permit to enter or remain at the Property;
behaving in a lawful, respectful, and honest manner while on or around the Property;
being legally authorized to act on behalf of and supervising any minor you permit to enter or remain at the Property.
Guest Assumption of Risk. You acknowledge that occupying any property involves inherent risks and you agree that, to the maximum extent permitted by law, you assume the entire risk arising out of your access to and use of the Property, use of the Services, or any other interaction you have with other Users whether in person or online. Doc to Doc Rentals is not responsible for, and makes no representations or warranties about:
the existence, condition, quality, safety, or legality of the Properties listed through our Services;
the truth or accuracy of any Listing, rating, review, or any other User Content (as defined below); or
the ability, right, or authorization of any Registered User to post Listing(s) through our Services.
Listing. To use the Services to list or offer your Property for rental you must be a Registered User who is a licensed physician and must verify that by providing us your physician license number. Within the parameters of the Services, you are in control of the information you include in your Listing, the rental price and other fees, rules, standards, policies, or requirements that apply to a Reservation of your Property.
For each Listing, you are solely and fully responsible for providing clear, complete, accurate, and not misleading information, descriptions, and images of the Property, its availability for booking, and any charges, terms, policies, or conditions applicable to Reservations of the Property. Any terms, policies, or conditions that you include in any supplemental contract with Guests must be prominently disclosed in your Listing description and be consistent with these Terms (including, as a reminder, our Privacy Policy and Acceptable Use Policy (at the end of these Terms)) and the information provided in your Listing (including the tier and cancellation policy options you selected).
When you publish a Listing, you will choose a tier and cancellation policy for the Listing, which will determine the Service Fees and some other conditions applicable to your Listing. Details on the tiers and cancellation policies are available on our website. Doc to Doc Rentals offers the ability to collect taxes for your Reservation, which can be paid out separately. If you request that we collect taxes for you, you are solely responsible for determining the rates or amounts of taxes to be collected and we will not be responsible or liable for any errors you make in determining those rates or amounts.
Reservations. When you accept a booking request, or receive a booking confirmation through the Services, that Reservation is complete. This means that you (a) are entering into a contract directly with the Guest, (b) are responsible for delivering the Property under the terms and at the price specified in your Listing, (c) will pay our Service Fees and any applicable taxes associated with the Reservation. We will deduct our Service Fees and any other amounts you owe to us or a Guest from your account balance or payment mechanisms (unless we and you agree to a different method for payment) and will credit any amount payable to you from payments by your Guests.
Modifications. Guests and Hosts are responsible for any booking modifications they agree to make via the Services, including any additional amounts, fees, or taxes associated with the modification. If you agree to any modifications, you will notify Doc to Doc Rentals of the details by email to: doc2docrentals@gmail.com.
Host Responsibilities and Our Relationship. As a Host, you are responsible for being aware of and complying with all government rules, regulations, and other laws that apply to you and your property and for complying with any contracts you are a party to (such as homeowner association rules). For example, some landlords and leases, or homeowner and condominium association rules, restrict or prohibit subletting, short-term rentals and/or longer-term stays. Some cities have zoning or other laws that restrict the short-term rental of residential properties. Some jurisdictions require that you register Guests who stay at your Property. Some jurisdictions have laws that create tenancy rights for Guests and additional obligations for Hosts. For example, some places have landlord-tenant, rent control, and eviction laws that may apply to longer stays.
You understand and agree that: (a) you may only use our Services for the purposes stated in these Terms; (b) you may only list Properties that you own or you otherwise have full authorization or right to rent; (c) you may only create up to two Listings for each Property; (d) you will be solely and fully responsible for fulfilling your obligations under any Reservations; and (e) Doc to Doc Rentals cannot guarantee exact Listing durations, or the appearance or placement of any Listings in search and browser results.
Doc to Doc Rentals acts as a limited purpose payment collection agent for amounts due to you in connection with a Reservation, including Damage Claims. Otherwise, your relationship with Doc to Doc Rentals is that of an independent individual or entity and neither of us are an employee, agent, joint venturer, or partner of the other. Doc to Doc Rentals does not direct or control your Property, you have complete discretion whether and when to provide information about and access to your Property, and at what price and on what terms to offer Reservations.
Doc to Doc Rentals does not screen Registered Users or conduct any kind of identity or background checks over them (other than confirming that physician license numbers are valid). Doc to Doc Rentals is not a party to your Reservation contract. Doc to Doc Rentals has no control over the acts or omissions of any Guests and is not responsible for the conduct of any Guests or other third parties or their use of your Property.
“User Content” is defined as any content, information, text, images, photos, videos, listings, and/or other materials that you, as a User, post or submit to the Services or provide to another User through the Services, including profile information, reviews, ratings, images and descriptions of any Properties, messages posted on community forums or sent to other Users. You agree and warrant that you will not provide any User Content that violates these Terms (including, as a reminder, our Acceptable Use Policy (at the end of these Terms)).
You retain all rights in, and are solely responsible for, all User Content provided by you to or through the Services. To the extent that you provide any User Content, you grant Doc to Doc Rentals a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, fully-transferable, and sub-licensable (through multiple tiers) license to copy, distribute, modify, create derivative works based on, publicly perform, publicly display, sell, monetize, and otherwise use the User Content. You represent and warrant that you have the necessary licenses, rights, consents, and permissions (including all permissions required under applicable privacy and intellectual property law) to provide the User Content to us and other Users and to grant the license described above. We have the right, but not the obligation, to remove or modify User Content for any reason, including User Content that we believe violates these Terms.
As a Guest, you are also agreeing that Doc to Doc Rentals may charge the payment method used to book the Listing for the Total Price, other charges you agree to in connection with a Reservation (such as for modifications to a Reservation), and (if necessary) to collect amounts for Damage Claims (defined below).
As a Host, for each listing you post, you will pay Service Fees based upon the tier you choose for each listing. The Service Fees can be viewed here [[LINK]]. Doc to Doc Rentals may change the Service Fees at any time by posting the changes
All Service Fees and other charges are billed and payable in U.S. dollars and are exclusive of any applicable taxes and any fees charged to you by any third parties (e.g., PayPal or Stripe). The Service Fees are non-refundable.
We currently only accept PayPal for subscription fee payments. Please note that your use of PayPal is subject to PayPal User Agreement (currently available at https://www.paypal.com/us/webapps/mpp/ua/useragreement-full) and PayPal Privacy Statement (currently available at https://www.paypal.com/us/webapps/mpp/ua/privacy-full?locale.x=en_US).
Disclaimers and Risk Allocation
PLEASE READ THESE DISCLAIMERS AND RISK ALLOCATION SECTIONS CAREFULLY AS THEY DEFINE AND LIMIT YOUR LEGAL RIGHTS.
Acceptance of Risk. You expressly agree that your use of the Services is at your sole discretion and therefore at your sole risk. You should make your own assessments of any User or anyone else you decide to interact with online or offline and take all necessary precautions. Except as expressly stated in these Terms, Users must resolve any issues, disputes, or concerns directly with each other.
No representation or warranties. The services are provided on an “as-is” and “as-available” basis. Doc to Doc Rentals makes no warranties regarding the Services, and hereby disclaims all implied warranties or conditions of merchantability, fitness for a particular purpose, non-infringement of intellectual property or other violation of rights, and any warranties arising out of course of dealing or usage of trade. Doc to Doc Rentals makes no representations or warranties that: your access to the Services will be reliable, uninterrupted, or error-free; the Services will be free of viruses and malware; or the information obtained by you through the Services will be complete, accurate, reliable, true, or timely.
No responsibility for User or Third-Party Content, Conduct, or Services. Doc to Doc Rentals is not responsible or liable for the conduct of, or content or services provided by, any Users (online or offline) or third parties (including hackers or others who engage in the unauthorized access, use, or misappropriation of any User content or information) even if you experienced or encountered that content, conduct, or services in connection with our Services.
TO THE MAXIMUM EXTENT PERMITTED BY applicable LAW, DOC TO DOC RENTALS WILL not be liable for any DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS of use, loss OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (i) YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SERVICES; (ii) unauthorized access, use, or alteration of your account OR INFORMATION; OR (iii) your interractions with otherS, whether online or offline. The above limitations apply even if DOC TO DOC RENTALS haS been notified orally or in writing of the possibility of such damage.
You agree to indemnify, defend, and hold harmless Doc to Doc Rentals from any and all claims, liabilities, expenses, and damages, including reasonable attorneys’ fees and costs, made by any User or third party arising out of or related to: (a) your use or misuse of, or inability to, use the Services; (b) your breach of any of these Terms; (c) your violation of any law or rights of any User or third party; (d) your interactions with, conduct towards, or disputes with any other User or third party, or (e) any User Content provided by you, including any claim of infringement or misappropriation of intellectual property or other proprietary rights.
Links to Third-Party Sites
You may see links to third-party sites on the Services. We allow such links for informational purposes. Doc to Doc Rentals has no control over, does not endorse, and is not responsible for, the content, products, or services provided by such linked sites. Your use of third-party sites, services, or products may be subject to associated third-party terms of use and privacy policies or other agreements, which you are solely responsible for complying with. Third-party providers for such sites are solely responsible for their sites and related services or products, and use of any content of such sites or any products or services offered therein is at your own risk.
Changes and Termination of the Services
We are constantly looking to improve our Services. We may add, change, or remove content, functions, features, or requirements, and we may suspend or stop a Service altogether. As stated in Section 4 above, we also reserve the right to terminate your use of any Service for any reason at any time.
Resolving Complaints and Damage Claims.
We encourage all Guests and Hosts to work in good faith to resolve any complaints, damage claims, or other disputes in a kind and respectful way. If a Host provides Doc to Doc Rentals with valid evidence that you, your pet, or anyone you permit to enter or remain at the Property damaged the Property or associated personal property (a “Damage Claim”) then you will be notified of the Damage Claim and given an opportunity to respond. If you agree to pay, or if the Damage Claim is escalated to Doc to Doc Rentals and we determine in our sole discretion that the Damage Claim is valid and you are responsible for the Damage Claim, we can collect the amount of the Damage Claim from you. You agree that Doc to Doc Rentals may seek to recover from you under any insurance policies you maintain. Nothing in this section requires that Doc to Doc Rentals adjudicate or enforce any Damage Claim. Nothing in these Terms precludes Doc to Doc Rentals or a Registered User from seeking lawful remedies in connection with any claims for damages, subject to the Disclaimers and Risk Allocation section.
Governing Law. These Terms are governed by the laws of the State of Washington, without regard to its conflict of law provisions. Any legal suit, action, or proceeding arising from or related to these Terms will be brought exclusively in the state or federal courts located in King County in the State of Washington, and you agree to irrevocably submit to the exclusive jurisdiction and venue of those courts in any such action or proceeding.
Severability. If any of these Terms is determined to be invalid or for any reason unenforceable, then the invalid or unenforceable term will be deemed severable, and the remainder of the provision will be amended to achieve as closely as possible the effect of the original term and all other provisions of these Terms will continue in full force and effect.
Assignment. Doc to Doc Rentals may assign these Terms, in whole or in part, at any time with or without notice to you. You may not assign these Terms, or assign, transfer, or sublicense your rights, if any, in the Services.
No Waiver. Doc to Doc Rentals’ delay or failure to assert any right or provision under these Terms does not constitute a waiver of such right or provision.
Force Majeure. In no event shall Doc to Doc Rentals be responsible or liable for any failure or delay in the performance of its obligations under these Terms arising out of or caused by, directly or indirectly, Acts of God, emergencies, pandemics, mechanical or Internet failure, regulatory or other governmental action, or other events beyond its control.
Notice. You consent to receive communications from us electronically, such as e-mails, texts, mobile push notices, or notices and messages on the Site or Apps or otherwise through the Services. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
California Residents. If you are a California resident, in accordance with California Civil Code Section 1789.3, you may report complaints to the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs by contacting them in writing at 1625 N. Market Blvd., Suite S-202, Sacramento, California 95834, or by telephone at (800) 952-5210.
Digital Millennium Copyright Act. If you are a copyright owner or an agent of a copyright owner and believe that any content on the Site or Apps infringes upon your copyrights, you may submit a notification pursuant to the Digital Millennium Copyright Act (“DMCA”) by providing our Copyright Agent with the following information in writing (see 17 U.S.C 512(c)(3) for further detail):
a physical signature of the person authorized to act on behalf of the copyright owner;
a description of the copyrighted work that you claim has been infringed upon;
a description of where the material that you claim is infringing is located;
your address, telephone number, and e-mail address;
a statement by you that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and
a statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf.
You may direct copyright infringement notifications to our Copyright Agent at doc2docrentals@gmail.com. You acknowledge that if you fail to comply with all the requirements of this Section, your DMCA notice may not be valid.
Additional Terms for Mobile Apps
Mobile Apps. To use any Doc to Doc Rentals App, you need to make sure that you have a compatible mobile device. We are not in the position to and cannot warrant that the App will be compatible with your mobile device. You agree to be solely responsible for any additional charges from your wireless provider for using an App. Our Apps may include components that are third-party open source software subject to the applicable open source license. These Terms do not apply to your use of any software obtained from a third-party source under an open source license.
License and Update. Subject to your compliance with these Terms (including the Acceptable Use Policy (at the end of these Terms)), we grant you a non-exclusive, limited, revocable, personal, non-transferable, and non-sublicensable license to use any software components we make available to you through the Services, including the Apps, and to download and use the Apps on your mobile device in object code form, for your personal use. Except as expressly stated herein, these Terms do not provide you with a license to use, reproduce, distribute, display or provide access to any portion of the Apps or other Services on third-party web sites or otherwise. We may update any App and may automatically and electronically update the version of any App that you have installed on a mobile device. You consent to all automatic upgrades and understand that these Terms will apply to all updated versions of an App.
Export Regulation. The Doc to Doc Rentals Apps may be subject to U.S. export control laws, including the Export Control Reform Act and its associated regulations. You shall not, directly or indirectly, export, re-export, or release the Doc to Doc Rentals Apps to, or make the Doc to Doc Rentals Apps accessible from, any jurisdiction or country to which export, re-export, or release is prohibited by law, rule, or regulation. By using the Doc to Doc Rentals Apps, you represent and warrant that you are a U.S. User and will use the Doc to Doc Rentals Apps in the U.S. only.
Additional Terms for iOS Users. If you are using the Doc to Doc Rentals App on an iOS device (the “Doc to Doc Rentals iOS App”), these additional terms apply. You acknowledge that these Terms are between you and Doc to Doc Rentals only, not with Apple Inc. (“Apple”), and Apple is not responsible for the Doc to Doc Rentals iOS App or the content thereof. You acknowledge and agree that the license granted to you in this Section is limited to your use of the Doc to Doc Rentals iOS App as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions. Apple has no obligation to furnish any maintenance or support services with respect to the Doc to Doc Rentals iOS App. To the maximum extent permitted by applicable law, Apple will have no warranty obligation whatsoever with respect to the Doc to Doc Rentals iOS App. Apple is not responsible for addressing any claims of you or any third party relating to the Doc to Doc Rentals iOS App or your possession and/or use of the Doc to Doc Rentals iOS App, including, but not limited to: (a) product liability claims; (b) any claim that the Doc to Doc Rentals iOS App fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy, or similar legislation. Apple is not responsible for the investigation, defense, settlement or discharge of any third-party claim that the Doc to Doc Rentals iOS App or your possession and use of the Doc to Doc Rentals iOS App infringe such third party’s IP Rights. You represent and warrant that (1) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (2) you are not listed on any U.S. Government list of prohibited or restricted parties. You must comply with applicable third-party terms of agreement when using the Doc to Doc Rentals iOS App, e.g., you must not be in violation of your wireless data service agreement when using the Doc to Doc Rentals iOS App. Apple, and Apple’s subsidiaries, are third party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce this Section on mobile applications against you as a third-party beneficiary thereof.
Doc to Doc Rentals reserves the right to revise these Terms in our sole discretion at any time. For any material changes to the Terms, we will take reasonable steps to notify you of such changes. In all cases, your continued use of the Services after posting of such changes, with or without notification, constitutes your agreement to the revised Terms.
You agree not to, and not to permit or encourage others to, do any of the following:
use our Services if you are under eighteen (18) years old or are suspended or terminated from using our Services;
permit anyone else to use your login information, password, or account;
attempt to gain unauthorized access to other’s accounts or to the Services;
interfere with any other Registered Users’ listings, or restrict or inhibit any other Users from using and enjoying the Services;
post or distribute any untrue, inaccurate, misleading, or deceptive information or images in any listing or elsewhere in or through the Services;
manipulate the reviews or rating of any listing (e.g., leaving untrue, disparaging, or inappropriate ratings or reviews or leaving inflated ratings or reviews to artificially increase the desirability of a property);
post or distribute any profane, defamatory, libelous, infringing, hateful, distasteful, obscene, unlawful, or otherwise objectionable content;
distribute any political campaigning, mass mailings, chain letters, pyramid schemes, junk, or any form of “spam”;
infringe the copyright, trademark, patent, publicity, moral, and/or other IP Rights of Doc to Doc Rentals, any Users, or others;
modify, decompile, disassemble, or reverse engineer any software contained in the Services or make attempts to do so;
violate or circumvent any security features of the Services or make attempts to do so;
upload or distribute viruses, worms, Trojan horses, time bombs, spiders, or any other similar software, malware, or materials that may damage, interfere with, or overburden the Services;
reproduce, duplicate, copy, sell, re-sell, or exploit any information, materials, or content obtained from the Services;
use the Services or any information obtained from the Services to solicit, advertise to, or contact Users for any purposes not specified or allowed in the Terms;
user the Services for the purposes of creating competing products or services;
use data mining, robots, or similar data gathering and extraction tools;
impersonate another person or misrepresent your affiliation with another person or entity;
defraud, defame, harass, stalk, threaten, or harm others, or otherwise violate the legal rights of others;
use the Services or engage with other Users in any manner that violates applicable laws or regulations; or
otherwise violate the Terms of Service.
